These Terms of Service (“Terms”) govern your use of Tabator: the Tabator Android app, the web app at app.tabator.com, and the website tabator.com (together, the “Service”), provided by Udimi Productions, SL (“we”, “us”, or “our”).

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Tabator is an interval timer for Tabata and HIIT workouts. It lets you create and save workout templates, run timed intervals, track estimated calories and workout statistics, sync your data across devices, and share workouts and templates with friends.

2. Health and Safety

High-intensity exercise can be physically demanding. Consult a doctor before starting any exercise program, especially if you have a medical condition. Stop exercising if you feel pain, dizziness, or discomfort. The Service does not provide medical advice, and calorie values are estimates only. You exercise at your own risk.

3. Your Account

You can use the app with an account created on your device or by signing in with Google. You are responsible for all activity under your account and for keeping access to your device and Google account secure. Tell us promptly at contact@tabator.com if you suspect unauthorized use of your account.

You own the workouts, templates, notes, and photos you create in the Service. You give us permission to store, process, and display this content only as needed to provide the Service, including showing it to the people you choose to share it with. You are responsible for the content you share.

6. Subscriptions and Payments

Some features may require a paid subscription. Subscriptions are purchased and billed through Google Play, and prices, renewal, cancellation, and refunds are governed by Google Play’s terms. You can manage or cancel your subscription in your Google Play account settings.

8. Intellectual Property

The Service, including its software, design, music, branding, and content (other than your content), is owned by Udimi Productions, SL or its licensors and is protected by intellectual property laws. These Terms do not transfer any of these rights to you.

9. Termination

You can stop using the Service and delete your account at any time in the app settings. We may suspend or terminate your access if you violate these Terms or misuse the Service.

10. Service Availability

We aim to keep the Service reliable, but we do not guarantee that it will be uninterrupted or error-free. We may change, suspend, or discontinue any part of the Service at any time.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, Udimi Productions, SL will not be liable for any indirect, incidental, special, or consequential damages, or for any injury or loss of data arising from your use of the Service. Our total liability for any claim related to the Service will not exceed the amount you paid us during the three months before the claim arose, or USD $100 if you have not paid us.

You agree to indemnify and hold harmless Udimi Productions, SL from any claims, damages, and expenses arising from your violation of these Terms or of the rights of others.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page and change the “Last updated” date above. If you continue to use the Service after the changes take effect, you accept the updated Terms.
